Unexplained wealth and confiscation..Unexplained Wealth Unexplained wealth refers to the difference between a person’s overall wealth and lawfully acquired wealth OR the difference between income lawfully acquired for a period and their expenditure for that same period. The Supreme Court of Queensland must make an order requiring payment of the person’s unexplained wealth when it is satisfied there is reasonable suspicion that the person engaged in serious crime related activity or acquired property from a serious crime related activity. It is irrelevant whether or not the person knew or suspected the property was derived from illegal activity or that any of the person’s current or previous wealth was acquired unlawfully. All that needs to be proved is that the wealth was acquired through unlawful means. The Court may refuse to make an order or reduce the amount payable, if it is satisfied that it would not be consistent with the public interest to make an order. There is also scope for dependents of a person against whom an order is made, to apply for property to be excluded from the order on the basis that they would suffer hardship if the property were confiscated. A person against whom an order is to be made as well as anyone else reasonably suspected of being affected by the order must be given notice that an order has been sought and given the opportunity to respond. Serious Drug Offender Confiscation Orders In contrast to unexplained wealth orders, serious drug offender certificates follow sentencing. Courts must issue a serious drug offender certificate upon conviction for serious drug offences. The state then has up to 6 months from the issuing of the certificate to apply to the Supreme Court for a serious drug offender confiscation order. A serious drug offender confiscation order forfeits to the state all property (other than protected property) of the prescribed respondent within 6 years before the respondent was charged with the offence on which brought about the issuing of the certificate. Protected property is property which wouldn’t be divisible amongst creditors if the respondent was declared bankrupt.
